Fastly Developer Hub Terms of Use

Welcome to the Developer Hub. These Terms of Use (“Terms”) govern your access and use of the Site.

Definitions

The “Site” refers to the Fastly Developer Hub website and any site that links to these Terms, including all content, tools, and features provided by Fastly at or through the Site.

“Content” refers to content featured or displayed through the Site, including text, data, articles, images, photographs, graphics, software, code snippets, applications, designs, tools, experiments, tests, features, and other materials that are available on the Site.

“Fastly”, “we” and “our” refers to Fastly, Inc.

“User-Generated Content” is content posted or uploaded by You.

“You” and “your” refer to the individual person, company, or organization using the Site.

Service and Disclaimer of all Warranties

You do not need an account to Fastly’s services to access or use this Site. Although it may discuss or relate to Fastly’s products and services, this Site is not a Fastly service subject to the Fastly Terms of Service.

Fastly makes no representations as to the accuracy or completeness of any Content on this site or found by following any link on this Site. Fastly provides the Site (including all Content, tools and demos) “as is” and “as available,” without warranty of any kind. We expressly disclaim all warranties, whether express, implied or statutory, regarding the Site including any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement. All Content is provided for informational purposes only.

You assume full responsibility and risk of loss resulting from your use of information, content or other material obtained from the Site.

Feedback. You grant to Fastly worldwide, perpetual, irrevocable, royalty-free permission to use and incorporate into the Developer Hub, Fastly Labs and/or Fastly’s products and services any suggestion, enhancement request, recommendation, correction, or other feedback you provide.

Fastly reserves the right to offer products or services based upon or related to Fastly Developer Hub Content and feedback.

Acceptable Use

The Site shall not be used by any person in any way that violates any law or regulation or in a manner that harms or infringes the rights of Fastly or any other person.

From time to time, the Site’s Content may include interactive tools or features. Abuse or excessively frequent use of Fastly Labs interactive tools or features is prohibited. You should not use the interactive tools, free text fields, forms, or similar features to input personal information, unless personal information is expressly requested by us.

User-Generated Content

If the Site allows you to create or upload User-Generated Content, then You are solely responsible for the content of, and for any harm resulting from, any User-Generated Content that you post, upload, link to or otherwise make available via the Site, regardless of the form of that Content. We are not responsible for any public display or misuse of your User-Generated Content.

Fastly Labs May Remove Content

We reserve the right to remove any User-Generated Content posted, uploaded, linked to or otherwise made available to the Site.

Ownership of Content, Right to Post, and License Grants

You own your User-Generated Content. You are responsible for your User-Generated Content and must have all rights or license to share any Content your post or upload. You grant to Fastly a worldwide, perpetual, irrevocable, royalty-free permission to use and incorporate the User-Generated Content into Fastly Labs and/or Fastly’s products and services.

No Confidentiality. This Site includes tools that permit you to input data to be analyzed or processed. Fastly owes no confidentiality obligations to you for any data entered into or uploaded to the Site (including using tools made available through the Site). Any data entered into or uploaded to the Site or can be viewed by anyone on the Internet.

If you believe that Content on the Site violates your copyright, please contact Fastly in accordance with Fastly’s Digital Millennium Copyright Act Policy in Section IV of Fastly’s Acceptable Use Policy.

Intellectual Property

Fastly and its licensors own the Site, all logos and trademarks associated with Fastly and the Site, and all the Content (except for User Generated Content) published on the Site and retain ownership of all intellectual property rights of any kind related to the Site. You do not have permission to use Fastly’s logos, trademarks or other intellectual property without Fastly’s prior written consent.

Data Collection and Privacy

This Site uses Fastly Insights and collects information about HTTP and HTTPS network transactions, including: network routing, performance timing, and equipment characteristics. You can read more about Fastly Insights here.

Use of this Site is subject to the Fastly Privacy Policy and Cookie Policy.

Limitation of Liability

You agree that we will not be liable to You or any third party for any losses or damages, however arising, that result from use of or inability to use the Site, our use of your User-Generated Content or any other matter relating to the Site or the Content.

Release and Indemnification

You agree to indemnify us, defend us, and hold us harmless from and against any and all claims, liabilities, and expenses, including attorneys’ fees, arising out of your use of the Site, including but not limited to your violation of these Terms.

Changes to These Terms

We reserve the right, at our sole discretion, to amend these Terms at any time and will update these Terms in the event of any such amendments. Your continued use of the Site constitutes agreement to the revised terms. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Site (or any part of it) with or without notice.

Miscellaneous

Governing Law

These Terms and any access to or use of the Site by you are governed by the laws of the State of California, without regard to conflict of law provisions. You and Fastly agree to submit to the exclusive jurisdiction and venue of the courts located in the City and County of San Francisco, California.

Non-Assignability

Fastly may assign or delegate these Terms, in whole or in part, to any person or entity at any time with or without your consent, including the license grants. You may not assign or delegate any rights or obligations under the Terms without Fastly’s prior written consent, and any unauthorized assignment and delegation by you is void.
